Posting and Distributing Informational Materials
As described in Board Policy 1326, the District has a substantial interest in promoting an educational atmosphere in its schools. The District also has a substantial interest in preventing the commercial exploitation of its students.
The District recognizes the need by community groups and/or individuals to post or distribute fliers to students for purposes other than the conduct of the instructional program. Newport-Mesa Unified School District uses an electronic flier distribution system (Peachjar), which reduces staff time, saves money, embraces technology, and continues our mission of being an environmentally conscious school District. Since moving to this electronic flier distribution system in April 2014, we have saved more than 10 million sheets of paper!

Use of the District flier distribution system shall be under the supervision and control of the Superintendent or designee(s). Approval for any and all flier distribution requests will be at the discretion of the superintendent or designee(s). The District reserves the right to deny any request.
Fliers will be automatically submitted to the District. The District will review the information submitted and determine if the request is in accordance with District policy. The District typically reviews flier posting requests within 7-10 working days, excluding holidays and District observed breaks. Please submit your fliers well in advance for optimal promotion opportunities.
Guidelines for Online Flier Distribution
Guidelines are set by the District to ensure that individuals and groups receive equal consideration in the determination of access to the flier distribution system. These guidelines, which are not an exhaustive or comprehensive list of instructions or regulations, include:
- An organization requesting flier distribution must be a qualified nonprofit organization in good standing with the California Secretary of State and/or Internal Revenue Service.
- The organization requesting the use of the flier distribution system must be the lead organization hosting, managing and collecting any fees for the event and therefore must have proof of its own nonprofit status.
- The information to be disseminated must adhere to one or more of the following categories; recreational, educational, charitable, or artistic interests of the school community or the discussion of matters of general or public interest.
- Fliers must be translated, by the distributing individual or organization, from English into the second language of the school community, as appropriate.
- Fliers must not interfere, conflict or compete with the educational programs of the District and must not disrupt the daily operations of the District or school instructional program.
- The posting and distribution of fliers must be in compliance with all laws, rules and regulations, as established by the State of California, and District Board Policies and Administrative Regulations.
- The District does not permit the distribution of fliers for commercial purposes or purposes unrelated to the District's educational mission.
- The District will not permit distribution fliers that promote the following:
- Discrimination against, attack or denigrate any group on account of gender, race, age, color, religion, ancestry, national origin, disability or other unlawful consideration.
- Violence, or perceived violence, of any kind
- Lewd, obscene, libelous, or slanderous information
- Consumption of alcoholic beverages or the use of illegal drugs and/or narcotics
- Gambling, games of chance or other related activities
- Promote, or perceived promotion, of an activity that would favor one particular denomination over another, or favor all religions over non-religious practices (or vice versa)
- Promote, or perceived promotion, of any particular political interest, candidate, party, or ballot measure
Organizations or individuals that engage in violations of the guidelines may be banned from future distribution of promotional and/or informational materials.
SCHOOL SITES
School sites are permitted to approve fliers for distribution to their school community, at the discretion of site administration and in accordance with all laws, rules and regulations, as established by the State of California and District Board Policies, Administrative Regulations and these guidelines.
Schools are able to electronically post fliers on the school(s) website and email fliers, free of charge, to promote school newsletters, fundraisers, plays, etc.
Schools that would like to request flier distribution for events and programs that are appropriate for an audience larger than their particular school community may work with the District to request distribution. Please note that fundraisers are limited to the school that it benefits. If fundraisers benefit a larger community, the District may consider distribution to the appropriate zone(s) or perhaps District wide, as considered appropriate by the District.
School sites may not distribute outside organization fliers. However, school sites may distribute School Connected Organization (SCO) fliers, as long as the guidelines below for SCO are enforced.
SCHOOL CONNECTED ORGANIZATIONS (SCO) - PTA, FOUNDATION, BOOSTER, ETC.
School Connected Organizations (SCO) may work directly with their school site administration to post electronically and email appropriate fliers to their school community, free of charge. These fliers are posted at the discretion of site administrator, in accordance with all laws, rules and regulations, as established by the State of California and District Board Policies and Administrative Regulations. In addition, the following disclaimer must be included on fliers:
“Newport-Mesa Unified School District neither endorses nor sponsors the organization or activity represented in this material. The District accepts no liability or responsibility for the program/activity. The distribution or display of this material is provided as a community service.”
Please note that in the summer, booster organizations operate under the Enrichment and Community Organization category. This is to prevent the perception that participation in non-District managed summer programs are reflective of participation in the District managed school year programs.
ENRICHMENT AND COMMUNITY ORGANIZATIONS (NOT CONNECTED TO NMUSD)
- An organization requesting flier distribution must be a qualified nonprofit organization in good standing with the California Secretary of State and/or Internal Revenue Service.
- The organization requesting the use of the flier distribution system must be the lead organization hosting, managing and collecting any fees for the event and therefore must have proof of its own nonprofit status.
- Qualified organizations should visit the District flier distribution system (Peachjar) to register as an “Enrichment or Community Organization.”
- Organizations will upload their IRS nonprofit status letter and the flier that they would like to be considered for distribution.
- Organizations will select which school communities they would like the flier to be distributed to. Options include specific schools, categories of schools -- such as elementary, middle or high -- or select school zones.
- Organizations will select how long a flier is to remain active on a school website(s).
- Fliers will be automatically submitted to the District. The District will review the information submitted and determine if the request is in accordance with District policy. The District typically reviews flier posting requests within 7-10 working days, excluding holidays and District observed breaks. Please submit your fliers well in advance for optimal promotion opportunities.
- Organizations will be notified, through the flier distribution system (Peachjar), if their flier was approved, denied or if additional information is required. If approved, organizations will have two options for flier distribution:
- The flier may be posted electronically to selected school websites, free of charge.
- The flier may also be emailed to students, parents, staff and community members who have registered to receive fliers. The flier distribution system (Peachjar) charges a fee for this service. Fees are set and collected by Peachjar. Service fees may be waived when a local community organization is promoting a free event that does not entice participants to join a fee-based program or purchase products or services. To qualify for the Community Free Flyer Program, organizations can email support@peachjar.com.
- Please note that all fliers will automatically include the following disclaimer:

Organizations or individuals that engage in violations of the provisions of this administrative regulation may be banned from future distribution of promotional and/or informational materials.
